Where things stand today

Today, tobacco-free nicotine pouches are not regulated as a product of their own in Spain. The Spanish tobacco law (Ley 28/2005) covers tobacco products, and nicotine pouches contain no tobacco, so there is currently no pouch-specific statute setting an age limit, a strength cap or a flavour rule. They are sold to adults aged 18 and over. Two proposals that would change the rules are under discussion.

Tobacco snus is a different matter: its sale is banned across the EU except in Sweden, and Spain applies that ban. 24Nico does not sell tobacco snus. What is often called «snus» in Spain is the tobacco-free nicotine pouch, and that is what our Spanish range sells.

Two proposals, neither in force

Two instruments that would regulate nicotine pouches have been drafted. Both are proposals: neither has been adopted, and neither binds anything today.

• A draft Royal Decree (Real Decreto) amending the tobacco-products regulation. As notified to the European Commission, it would define pouches as a product category, cap nicotine at 0.99 mg per pouch and allow tobacco flavour only. It is with the Consejo de Estado and has not been approved.
• A bill (Proyecto de Ley) reforming Ley 28/2005, now before the Congreso. As drafted, it would class pouches as «productos relacionados», set a statutory 18+ limit, ban their advertising and promotion including online, limit sale to specialised shops and treat cross-border distance selling as an infraction. It is in parliamentary procedure and has not been adopted.

If either is adopted, the rules — and the range we can offer — may change.

Age: 18 and over

Nicotine pouches are for adults. In Spain the age applied across the market is 18, by analogy with tobacco law, and the bill before the Congreso would write that limit into statute. Every order of nicotine products at 24Nico goes through an age check before it ships, and we cancel orders that do not pass.

What this means when you order from Spain

• Ordering for your own use is lawful. Buying nicotine pouches online from another EU country for personal use is ordinary cross-border shopping.
• No customs. Sweden and Spain are both in the EU, so there are no customs formalities and no customs charges on your parcel.
• One price, IVA included. Prices are shown in euros with 21 % IVA included, and there are no additional charges on delivery.
• Península and Baleares. We ship to mainland Spain and the Balearic Islands. We do not currently ship to the Canary Islands, Ceuta or Melilla.
• Up to 20 cans per order. Every order to Spain is capped at 20 cans; you will see a message in your basket if an order goes over.

What 24Nico does

• Sells nicotine pouches only to adults aged 18 and over, with age verification on every nicotine order.
• Shows one price per product with all taxes included, so nothing is collected on delivery.
• Does not sell tobacco snus, in Spain or anywhere else in the EU.
